Kenyan Steel Companies Appeal Against Collective Fine for Price Fixing and Output Restrictions

Nine steel companies in Kenya have been collectively fined Sh338 million by the Competition Authority of Kenya (CAK) for colluding on steel prices. The companies, including Nail and Steel Products, Brollo Kenya, Blue Nile Wire Products, Tononoka Rolling Mills, Devki Steel Mills, Doshi & Hardware, Corrugated Steel, Jumbo Steel Mills, and Accurate Steel Mills, were found guilty of price fixing and output restrictions, causing an artificial shortage that raised prices. All companies, except Accurate Steel Mills, have appealed the penalties before the Competition Tribunal. The fines, ranging from Sh9.2 million to Sh86.9 million, were imposed to restore competition in the sector and discourage anticompetitive practices. The CAK highlighted that the companies engaged in cartel conduct, inflating steel product prices and impacting the cost of construction. Price-fixing, as per Section 31 of the Competition Act, involves agreements between competing sellers to control prices by manipulating supply and demand.
